In today’s real estate market more sellers are turning to Short Sales as a way to avoid foreclosure.   Should they?   So, how does it work?
 
Selling short is definitely better than foreclosure, which stays on your credit record from seven to twelve years. But it's best to try to work things out with your lender before going through the embarrassing and laborious process of selling your home on a short sale.
 
In a short sale, the seller arranges with their mortgage lender to accept a price that's less than the amount they owe on the property. As part of this arrangement, the lender typically agrees to forgive the rest of the loan. As a result, the seller doesn't have to go through a foreclosure, the buyer picks up a property at a discount, and the lender avoids taking on the burden of unloading the property.

Sounds good right? Well, sellers need to know that a short sale may damage their credit, though probably not as much as a foreclosure. Also, lenders generally will only agree to a short sale if the seller is many payments behind and has received a default notice. Buyers may get a great property at a discount, but they also will need to go through some extra paper work too. Not to mention, they also need to be prepared to roll up their sleeves if that troubled property needs fixing up, as many of them largely do.

In many American cities, a Foreclosure sign in front of a neighboring home is no longer that unusual.
 
What is foreclosure and how does it happen? Does the homeowner have a chance to get back their home? Can I buy a home in foreclosure? Whether you're an investor, homeowner or in the market to buy, foreclosure process is important to learn about in today's real estate world.
 
Foreclosure is the final step in a process of a lender trying to recoup their money from a borrower who has defaulted on their loan. The bank either sells or takes back the home resulting in a foreclosure auction or bank foreclosure.
 
The first step on the road to foreclosure is the notice of default (NOD). After this there is a reinstatement period in the foreclosure process before the house is put up for auction. If the defaulted loan isn't taken care of in this time period, a notice of sale is sent to the owner, posted on the property and in the newspaper and the home is put up for auction.
 
In this turning point in the foreclosure process, the home is either purchased by the highest bidder, meeting the reserve set by the bank to recoup their loan balance, interest and additional fees or the home is repossessed by the bank, and the home becomes, bank or real estate owned (REO) property and can be purchased directly from them, often with a clean title.
 
A Real Estate Owned (REO) is a property that has been through the short sale and foreclosure process and is now held by the lending institution. When borrowers default on their monthly mortgage payments, lenders will start foreclosure proceedings beginning with the notice of default, through the pre-foreclosure stage and into the final foreclosure step of the bank taking possession of the home. These properties are often sold by banks at below market values, not always, in order to sell quickly. Many REO properties are sold “As Is” as they are expensive for banks to hold because they require maintenance and the bank may have to repay any liens against the property. REO properties can be a great option for anyone looking to buy a home because of the potential for savings. Being an REO, potential buyers have the ability to see the property and may be able to negotiate the closing costs if financing the purchase through the selling bank.
